For business owners and executives

Funding brokers text you every week. Start keeping score.

“Pre-approved for $250k.” “Following up on your application.” “Seen my email?” If you own a business or run one, your cell is on every merchant cash advance and business loan lead list there is. For sales texts to a Do Not Call number, the law allows up to $500 per violation, and up to $1,500 if a court finds it willful or knowing, for example after you told them to stop.

Sound familiar?

Same pitch. New number. Every week.

Funding brokers buy the same lead lists, text from rotating numbers, and sign with a first name only. Replying STOP gets you a new number the next week. It feels impossible to stop because it’s built that way.

It’s also what the Telephone Consumer Protection Act was written for. Every text after your STOP is part of the record, and the same few operations are behind many of them.

How this started

Our founder was a business owner getting buried too

Our founder ran restaurants in Los Angeles. Once his number landed on the funding lead lists, it never came off. Loan offers before 8 AM. “You’re approved” texts from a new number every few days. Reps who claimed he had applied when he never had. He replied STOP more times than he could count, and they kept coming.

So he stopped deleting them. He logged every text and call, traced the rotating numbers and first names back to the registered companies behind them, and sent his own letters. Some companies called within hours. Some settled, some never answered, and when a company wouldn’t pay, he filed in small claims court himself. His results are not typical.

Make Spammers Pay turns that process into a service for owners and executives who have better things to do with their time: we do the research, organizing and logistics, and you make every decision.

Why owners get buried

More spam, more to count

Volume

More texts, bigger counts

A regular consumer might get a few spam texts a month. Owners often get several a week, and every one goes in the count.

Repeat offenders

Same operations, new names

The funding brokers texting you are texting every other owner. Some of them may already be in our database, with the legal name, registered agent and contact file on hand.

Your time

One evening, then we do the digging

You export your phone data once, or have your assistant do it. We sort it, trace the companies, count every call and text, and hand you an organized file. What to do with it is your call.

Two questions first

Two questions before you start

Two things often come up for business owners. We ask about both up front so the facts are in one place before you pay for anything.

Question 1

Which phone is it hitting?

The Do Not Call Registry protects personal numbers. Courts often look at how a number is listed and used, and many have treated a cell phone on the Registry as personal even with some work use, though a company can argue otherwise. A number advertised as your business line on your website or Google profile is harder to call personal. The rule on prerecorded calls to a cell phone does not depend on whether the number is personal.

Question 2

Did you ever apply for funding online?

Many owners filled out a loan or funding form at some point, and that form often included consent to calls and texts. Under FCC rules you can take consent back any reasonable way, like replying STOP. An old application still matters, so it goes in your file up front.

The law

What the law sets

The TCPA allows up to $500 per violation, and up to $1,500 if a court finds it willful or knowing. Those are the amounts the law sets, not a prediction. California small claims courts hear claims up to $12,500 for an individual. Many claims end with no money.

Owner questions

Straight answers

My cell number is on my business cards. Can I still do this?

Possibly. The more your number is presented as a business line, the easier it is for a company to argue it isn’t a personal number protected by the Registry. Your account asks how the number is used and listed, so the facts are in one place. The rule on prerecorded calls to a cell phone does not depend on whether the number is personal.

I don’t have time for this.

You need one evening to export your phone data, and your assistant or office manager can do that part. After that we do the sorting, tracing and counting. With coaching, you can text us when a company responds and we add it to your file.

Can I do this for my managers’ phones too?

Each person pursues claims for their own phone number, so each person would be their own client. Email help@makespammerspay.com about setting up several people at once.

Will this come back on my business?

The TCPA lets people bring their own claims, and anything you send goes out under your own name, so you decide what to send and to whom. For advice about your own situation, talk to a lawyer.

What about the calls, not just the texts?

Calls are covered too, and calls with a prerecorded or robot voice have their own rule with no two-call minimum. Your carrier’s records show calls your phone blocked or silenced, which often don’t show up anywhere else.

Is this legal advice?

No. Make Spammers Pay is not a law firm. We provide education, evidence organizing, research and logistics for a flat fee. You decide what, if anything, to pursue, and you sign and file everything yourself.
