Terms and Disclaimer
Terms of service, refund policy and legal disclaimer for Make Spammers Pay. Not a law firm, no legal advice, no guaranteed results.
1. What we provide
Make Spammers Pay sells four packages: the Playbook (educational guide, templates and AI toolkit), the Evidence Report (a review and summary of phone records you provide), Report + Coaching (the report plus 90 days of help with evidence, research and logistics), and Executive Concierge (research, organizing and logistics support for one company, a flat $999, including the Evidence Report). Additional companies start at $599 each and are quoted before any work on them begins. Clients with the Evidence Report or higher can also add our help on any company we identify in their report, starting at $599 per company; the price for each company is shown in their account before they decide, and they can always handle it themselves instead. Package details and prices are listed on the home page.
2. No legal advice, no attorney-client relationship
We are not attorneys. Nothing on this site, in any report, guide, template, AI toolkit, email, call or coaching session is legal advice, and no attorney-client relationship is created. We do not represent you, prepare court filings on your behalf, file documents for you, or appear in court for you. Laws and court decisions change and differ by state. If you want legal advice about your situation, consult a licensed attorney in your state.
Executive Concierge. Concierge clients receive organizational and logistical support: intake, research, exhibit organization, a calendar of dates the client confirms, tracked mailing of letters the client has completed, approved and signed, coordination with a registered process server, and printed exhibit copies. Letters and forms are completed by the client, who can change any field before signing. The client makes every decision, reviews and signs their own letters and court documents, files their own court documents, keeps track of and meets every court deadline, and appears at their own hearings. Make Spammers Pay does not act for any client under a power of attorney, does not appear in court for anyone, and does not negotiate on a client’s behalf. Concierge clients confirm these terms in the agreements they sign in their account before work begins. Case expenses (Concierge). Out-of-pocket costs a Concierge client asks for or approves, such as printing, paper, postage and certified mail, are billed at actual cost plus a handling fee of up to 3% that is included in each expense’s total and applies however the client pays, plus a $0.50 billing fee each time the balance is charged. The card used at checkout is kept on file with Stripe for these expenses. Every expense and the running balance are shown in the client’s account, the card is charged when the balance reaches the amount stated in the client’s agreement or when balances are billed, and a receipt is emailed each time. The client can cancel this authorization at any time by messaging us and then pay any balance another way. Court filing fees and service fees are still paid by the client directly.
3. No guaranteed results
Dollar figures on this site and in reports are statutory amounts under 47 U.S.C. § 227 and related rules. They are not a promise or prediction of what you will recover. Results described on this site, including client feedback, are those people’s own and are not typical or guaranteed. Our founder has settled with multiple companies, but those settlement releases include confidentiality clauses, so we do not share company names, amounts or the number of settlements. Many senders cannot be identified or served, some companies never pay, and courts decide cases on their own facts.
4. Your responsibilities
- Only send us records for phone numbers you own or are authorized to use.
- Give us accurate information, including any prior relationship, application or consent you gave a company.
- Use the method and materials lawfully and honestly. Do not use them to harass anyone or to make false claims.
- Review, sign and take responsibility for any letter or filing you send.
5. Payment and refunds
- Payment is made on our site by card, Apple Pay or Google Pay, processed securely by Stripe. We never see or store your card number. Prices are fixed fees set before any work begins. We never take a percentage of any settlement or judgment.
- Start free, pay when you choose. Most clients begin with a free review: you create an account (no card is needed), sign the agreements and send your records. When the review is done you see a summary: how many senders, how many calls and texts of each kind, the amounts the law sets for those kinds of violations, and exactly what has and has not been identified for each one. Company names, numbers, the full report, the Playbook, the AI toolkit and the law library open after your first payment on a plan you choose. You can walk away after the summary with nothing owed. A plan is a purchase of the service at the price shown; you can pay in full, or in up to four monthly payments at 0% interest with no fees (the first when you choose, then monthly to your card on file). If a monthly payment does not go through we retry it and email you; if it is more than 10 days late your full results and downloads pause until it clears. The full price is owed; the monthly payments are a convenience, not a loan. Where Affirm or Klarna are offered, they set their own terms and are the lender. Plans and the Playbook can also be bought up front.
- Costs not included: your package pays for our service only. Pursuing a claim has its own costs, which you pay directly: court filing fees, service of process on each company, certified mail and postage, and sometimes fees for records. They vary by state and court and may not be recovered. This is not a quick fix. Cases take weeks to months, and some senders cannot be identified or served.
- After you pay, you create an account where you fill in your case information, sign your agreements and upload your records. Work begins when that checklist is complete.
- Playbook ($99): delivered digitally. Knowledge cannot be returned, so it is not refundable once delivered.
- Evidence Report ($297): not refundable once delivered. If you ask to cancel before we begin reviewing your data, we refund it in full.
- Report + Coaching ($697): the report portion ($297) is not refundable once delivered. If you are not satisfied with your coaching, you can ask for the coaching portion ($400) back before your 90 days end. The coaching period is 90 days from report delivery and does not pause or carry over.
- Executive Concierge ($999, one company): the Evidence Report and Playbook portion ($297) is not refundable once delivered. If no company can be named and served, or if you are not satisfied with the concierge service, you can ask for the concierge portion ($702) back before your case is closed. Court filing and service fees are paid by you directly and are not included.
- Refunds are about our service, not your case outcome. You make every decision in your case, and results depend on facts and courts outside our control.
- To ask for a refund, message us from your account or email help@makespammerspay.com. Approved refunds go back to your original payment method.
6. Your materials
The Playbook, templates and AI toolkit are licensed to you for your own personal use. Please don’t resell or republish them. Your phone data and your report belong to you.
Information about the spam senders in your records (their phone numbers, business names, addresses, websites, the wording of the messages they send and the companies they trace to) is kept in our private research database and may be used to help other clients identify the same companies. Your name, number, contacts, personal messages and report are never included, and nothing in it is ever sold or shared outside Make Spammers Pay.
In court. That same sender information (never your name, number, contacts or personal messages) may be used as evidence in court cases that Make Spammers Pay, the people who run it, or other clients bring against those senders, for example to show a pattern of calls or texts across many people. Where a filing needs to show that a contact happened, it is described without identifying you, unless you agree in writing or a court orders otherwise.
Your choice. You can turn this off at any time in your account under Privacy choices. Turning it off applies from that moment forward: nothing from your records after that date is added. Anything already added before then stays, because it has already been separated from your name, number and records and cannot be traced back to you.
Anonymized outcomes from your case (for example, how a company responded, which defenses it raised and whether it settled) may be added to our case library to improve future research. Settlement amounts and anything identifying you are never included.
7. Confidentiality and data use
You are trusting us with private records, and we are sharing methods and research that took years to build. This section protects both sides. It applies to every package, and you agree to it when you check the Terms box at checkout. Clients with an account also sign a Mutual Confidentiality Agreement there, which we countersign. It covers all data and every conversation between us in any form, including calls, video calls, texts, emails, account messages and voicemails. If the two ever differ, the signed agreement controls.
What it covers. “Your Data” means everything you send us or give us access to: call logs, text messages, voicemails, carrier records, screenshots, Do Not Call records, intake answers, and anything you tell us by phone, video, text or email. “Our Materials” means the Playbook, the AI toolkit (including the skill and case files), templates, sample letters, worksheets, company contact files from our database, and the format and methods of our reports.
What we promise you
- One purpose only. We use Your Data only to provide the services you choose, such as your report, research and logistics. We do not use it for any other purpose.
- No selling or sharing. We never sell, rent or share Your Data, never use it for marketing, and never contact anyone in your phone records.
- Limited access. Only people working on your account can access Your Data, and each of them is bound by these same confidentiality duties.
- Your personal contacts stay private. Calls and texts with family, friends and anyone who isn’t a spam sender are set aside and not used, recorded or kept.
- Trusted tools only. We may use service providers such as cloud storage, email and software tools, including AI assistants, to provide our services. We use them only for that and choose providers that protect the confidentiality of the data they handle.
- Keeping your records. We keep your records, report and cases in your account, even after a case closes or you archive a case, so everything is there if you come back with new calls. If you ask us in writing to delete them, we will, except anything we must keep for an open case, while a sender in them is under a legal hold (section 7A), or by law.
- Legal requests. We disclose Your Data only if you tell us to in writing, or if a law or court order requires it. If that happens, we will tell you first unless the law does not allow it.
- If something goes wrong. If we learn that anyone got access to Your Data who should not have, we will tell you promptly, including what happened and what we are doing about it.
What we keep. Information about the spam senders themselves (their phone numbers, business names, addresses, registered agents, websites and the wording of the messages they send) goes into our private research database, and anonymized case outcomes may go into our case library, as described in section 6. That sender information may also be used as evidence in court cases we, the people who run Make Spammers Pay, or other clients bring against those senders, as section 6 describes. Neither the database nor any such filing ever includes your name, your number, your contacts or your personal messages, unless you agree in writing or a court orders it. You can turn the research database part off at any time in your account under Privacy choices; it applies from that moment forward and does not remove what was already added.
What you promise us
- Your right to share. The phone number and records you send are yours, or you are authorized to share them, and you are responsible for what they contain.
- Your uploads and links. Files you upload in your account are stored privately on our server. If you share a link instead, you control that link: turn sharing off once we confirm we have everything. We are not responsible for your phone, your cloud provider, or your data while it is in your hands.
- Keep Our Materials confidential. Our Materials are licensed to you for your own claims only. Do not share, post, sell, copy for others or give them to anyone else, and do not use a company contact file from our database for anything other than your own claims against that company.
- Your filings are your choice. Anything you decide to send to a company or file in court, such as demand letters or exhibits, may become public. That is not a breach of this section by either of us.
7A. Keeping your evidence usable in court
Records only help in a demand or a court case if they can be shown to be real, complete and unchanged. So we handle them under a written evidence procedure, and we ask the same care of you.
What we do
- Originals stay unchanged. Every file you send is kept exactly as it arrived, with a fingerprint (SHA-256) taken when it arrives and, where our iPhone tool or app makes it, on your own device before it is sent. Copies we make are checked against that fingerprint. Every upload, view, download and deletion attempt is logged.
- Two copies. Your files are kept in our private website storage and in a second business-controlled copy, both with the list of fingerprints.
- Legal hold. Once a demand letter or notice goes to a sender, a case is filed, or the sender contacts us or you about the dispute, everything involving that sender is kept until the hold is released in writing. Nothing is deleted automatically.
- Your iPhone backup and its password stay on your computer. Our iPhone tool reads the backup on your own computer and sends only the export. The backup password is never sent to us or stored.
What you agree to
- Keep them on your phone. You keep every text, call and voicemail from the spam senders on your phone, even after you send them to us, and keep sending regular backups. If keeping them causes a problem (for example your phone runs out of storage), you tell us first and we decide together what can be done. Our answer and the reason are recorded.
- Screenshots as taken. You send screenshots exactly as you took them: uncropped and unmarked.
- Records custodian. Make Spammers Pay may act as the custodian of the records you send: it keeps them unchanged with their fingerprints and handling records, and a team member who knows how they were handled may sign a records custodian declaration about them for a demand or a court case.
- Your declaration. If a case goes forward, you review and sign a declaration about your phone number and your records, saying only what is true.
- Recorded calls. If you call a sender, or talk to one, and want to record it, you say “this call is being recorded” at the start. If you cannot, you do not record and write down what was said right after the call.
Clients who signed before October 13, 2026 are asked to accept these points in their account.
How long it lasts. These duties begin the moment you first send us information and continue after your case ends, for as long as either of us holds the other’s information.
8. Limitation of liability
To the fullest extent allowed by law, Make Spammers Pay’s total liability for any claim related to our services is limited to the amount you paid us for the package involved. We are not liable for indirect or consequential damages, or for the outcome of any claim, settlement or lawsuit you pursue.
9. Governing law
These terms are governed by California law. Any dispute about our services will be handled in Los Angeles County, California.
