Privacy Policy
How Make Spammers Pay collects, uses, stores and deletes your intake details and phone data.
This policy explains what information Make Spammers Pay (“we,” “us”) collects through makespammerspay.com, how it is used, and how long it is kept. Questions: help@makespammerspay.com.
What we collect
- Your account and case form: your name, email, login, the phone number receiving spam, your state, the package you chose, any links you share, what you tell us about the calls and texts, and the agreements you sign (with the date, time and IP address of your signature).
- Phone data you provide: for the Evidence Report, Coaching and Concierge packages, the call logs, text messages, voicemails, screenshots, carrier records, Do Not Call proof and contacts list you upload in your account or share by link.
- Email and messages: anything you send us through your account, by email or by text while we work together, and the calls you book with us.
- Payment: payments are processed by Stripe. We see your name, email, the amount and the last four digits of your card, never your full card number.
- Basic server logs: our web host records standard technical data such as IP address and browser type for security.
The SpamPaysYou phone app
Make Spammers Pay also operates as SpamPaysYou. Our Android and iPhone apps use the same account and this same policy. In the app:
- What you send: screenshots, voicemails, recordings, files and messages you choose to send from the app go into your account, the same as uploads on the website.
- Phone sync (only if you turn it on, and only in the full version we provide directly, not the Google Play version): the app reads the texts, picture messages and call history on your phone and sends only those from numbers that are not saved in your phone’s contacts, plus your replies to those numbers. Your contacts are checked on your phone and are never sent. Texts that are verification or login codes are left out. You see the totals before anything is sent, and you can turn automatic syncs off at any time.
- Catch alerts (optional, full version only): when a number that is not in your contacts texts you, the app can show a notification. That check happens on your phone; nothing is sent until your next sync.
- Spam protection (optional): if you turn it on, the app downloads our list of spam numbers (numbers reported in the FTC’s public Do Not Call complaint data, and numbers our members mark as spam) and checks incoming calls from numbers that are not in your contacts against that list, on your phone. Known spam goes to voicemail and likely spam rings silently (on iPhone: is blocked or shows a label), the way you choose in the app. On Android, the number and time of each call the app screens are saved to your account as part of your records. When you tap Spam or Not spam on a number, that mark is saved to your account and counts toward the shared list without your name or any other detail about you. Your contacts are never sent. You can turn it off in your phone’s settings at any time.
- Notification access (optional, Android full version only): if you allow it, the app looks at notifications from your phone and voicemail apps that mention a voicemail, so it can list the calls that left one, and it can hide the alert for a text from a known spam number (the text itself stays in your messages). It reads nothing else, and what it sees stays on your phone.
- iPhone: the iPhone does not let apps read texts or call history. The call blocker and the text filter use the spam list stored on your iPhone, and the iPhone does not tell the app about the calls or texts they handle, so nothing about them is sent to us.
- Sign-in and settings: the app keeps a sign-in key on your phone. We store a protected (hashed) copy of that key with your device name and app version, so you stay signed in and our team can sign a lost phone out. We also store your reminder time and sync settings.
- Reminders and notifications: the app shows the daily reminders you set and checks our server for messages from our team. It does not show ads, does not use advertising IDs and does not track you across other apps.
- Permissions: text, call history and contacts access are asked for only in the full version, only for phone sync, and you can turn any permission off in your phone’s settings. Signing out or deleting the app stops all of it.
How we use it
- To prepare your report, answer your questions and deliver the package you bought.
- To send you your receipt, your report, reminders about your checklist and messages about your case.
- To keep basic business and tax records.
We use AI tools to read and sort the phone records, screenshots and screen recordings you send: to set aside your personal contacts, log each sales call and text, and file it under the right company in your account. Our team checks what the AI finds. No one at Make Spammers Pay reads through your phone data or your personal messages: your contacts and personal threads are set aside unopened, and the only thing a person looks at is the list of spam senders and the counts the AI produces. These tools process your data only to do that work for your case. Our AI provider does not use it to train its models, and it is never used to sell or publish anything.
Your records are also protected by the confidentiality and data use section of our Terms, which you agree to at checkout, and by the Mutual Confidentiality Agreement you sign in your account.
What we never do
- We never sell or rent your information or phone data.
- We never add you to marketing lists, and we never call or text you for marketing.
- We never contact the people in your phone records.
- We never share your name, number, messages or report with other clients. When a spam sender in your records matches our database, what is reused is information about the sender, not about you.
How long we keep it
- Phone data: stored privately on our server, outside any public web folder, and only viewable by you and our team. Kept in your account, even after a case closes or you archive it, so everything is there if you come back with new calls. Each file is kept unchanged with a fingerprint (SHA-256), with a second business-controlled copy, and every view and download is logged. If you ask us in writing to delete it, we will, except anything involving a spam sender that is under a legal hold (after a demand letter, a filed case, or contact from the sender about the dispute), which we keep until the hold is released in writing. Our Terms, section 7A, explain this. If you use our iPhone tool, your backup and its password stay on your computer; only the export is sent.
- Spam sender information: the phone numbers, names, websites and company details of the senders who contacted you are kept in our research database, so we can identify the same companies faster for you and for future clients. This never includes your name, your number, your contacts or your messages. As our Terms describe, that sender information may also be used as evidence in court cases we, the people who run Make Spammers Pay, or other clients bring against those senders, never with anything that identifies you unless you agree in writing or a court orders it. You can turn the research database part off under Privacy choices in your account; it applies from that moment forward.
- Case outcomes: we may record anonymized results from your case, such as how a company responded, which defenses it raised and whether it settled, in our case library so future reports get better. This never includes your name, your number or your messages.
- Your report: kept in your account, so you can come back to it any time.
- Account, signed agreements and payment records: kept as business records as long as the law requires.
You can ask us to delete your phone data, your report or your whole account at any time by emailing help@makespammerspay.com, or in the app under More, Delete my account. How account deletion works.
Who else touches the data
Our website is hosted by SiteGround. Email runs through Google. Payments run through Stripe, which uses its own cookies on our checkout to prevent fraud. Fonts on this site load from Google Fonts. Each of these services handles data under its own privacy policy.
Cookies and tracking
This site does not use advertising cookies. If you create an account, we use a login cookie to keep you signed in. If we add analytics in the future, this policy will be updated first. We do not track visitors across other websites, so this site does not respond to browser “Do Not Track” signals; there is nothing to turn off.
Your rights
You can ask what information we hold about you, ask us to correct it, or ask us to delete it. California residents have additional rights under the California Consumer Privacy Act where it applies. Email help@makespammerspay.com and we will respond within 30 days.
Children
This service is for adults 18 and over. We do not knowingly collect information from children.
Changes
If this policy changes, the new version will be posted here with a new date.
